    I'm not sure what kind of lawyer I need ...

    but I think I might need one.

    Please know, I am not a litigious person.

    Our AC took a poop on Friday, right before I got home from 4 HOT days at Cub Scout Twilight Camp.

    The company that installed it, has a 24/7 service number. After a few calls, with no call backs, the lady told Tina "well, we need to sleep sometime".

    She called a second company, that responded and got a tech out here about 10am Saturday. He quickly figured out that the blower motor was going out, BUT there was MOLD all over the inside, and some outside of our air handler. He also told us that Carrier was known for this, and this was not the correct unit to install in an attic. It was meant for a climate controlled inside application like a closet.

    The tech from the company that installed it finally showed up about 6pm yesterday. I already knew about the mold (which will be tested tomorrow, but is blacker than a new tire) and he only said the blower motor was going out, but never mentioned the mold. I played the stupid card and asked him if all the black stuff in there was normal. He played it off and said yes, that's why we suggest a twice a year service plan, to clean that out.

    I told him that MOLD inside an air handler can't possibly be normal. And then went on to tell him that Tina had stage 4 cancer in her lungs. I can not prove or disprove that black mold blowing through our house could cause that, but he surely couldn't disprove it.

    We're waiting for a mold specialist to come out tomorrow, or Tuesday to test the whole house. Konnor is staying with a neighbor, while Tina and I robbed the portable AC from his playhouse to cool our bedroom and bathroom.

    Based on my past experience with the owner of the company that installed this AC, I think it's going to get real ugly. When the health of my family is involved, I'm not using kid gloves.

    What kind of attorney do I need to look for, and if you know, do you know a good one.

        Can't help on the attorney Kevin, but hope you find the one you need. Our A/C went out Friday as well. It was a hot night for sure. Had us back up and running by 2 on Saturday.

              The entire 40x80 barn is insulated with R13 between the metal and purlins.

              The framed up walls, inside have tyvex on the outside, with another layer of R13 batt insulation. I stuffed another layer of R24? between the building roof insulation, and the ceiling.

              I will admit, that it's not air tight, but I didn't think I'd have these kind of issues.

                The unit you described is ment to be in a "conditioned" space. And it's under the insulation of your roof panels. Second the tyvek being between 2 layers of insulation, that may be a problem. As well as insulating on top of your ceiling when your roof is already insulated. That would help to trap moisture up there.

                I am NOT saying this is your fault. But beware if lawyers get involved they will likely hire a building envelope engineer that will critique every detail of your building. And when lawyers get involved they are the only ones that win. Tread lightly OP, I wish you the best of luck.

                  Is the air handler outside the insulated envelope or inside it? Bottom line it sounds like you have a condensation issue. Gunna have to find out why. Need to understand that the envelope is a system all together. Its a sliding scale to get everything correct. Insulation R-value goes up AC size goes down. The AC has to run through its cycle so it can do its job especially dehumidifying. If it kicks on and cools too quick and shuts off it doesn't have time to properly dehumidify. In the old days we over sized AC's. Now with better insulation we have learned to use smaller AC units. I would have someone run the numbers on my system to make sure it is sized appropriately. Im sure someone will come along with a better understanding than I have and can make sense of what Im trying to say.

                    But I don't see how either of those could be a factor.
                    The tyvex and extra insulation makes it like a traditional home.
                    The extra in the ceiling, I don't see how more on the hottest part of your home could do any damage ... but thanks for the heads up!

                      Kevin, I understand your anger but Mission has some good points.

                      Starting with an engineer and AC system design expert before the lawyer will either save a bunch of money or confirm your need for a good lawyer

                        Wish you luck and can’t help much, but KG air out of Damon, TX is a solid outfit . I knew them before they started out, and have sent them many customers and no one has been dissatisfied. Super honest small business.

                              I pray for your family MrTaxi.
                              Anywhere there is an exchange of hot and cold with moisture…there will be microbial growth. It could be bare metal. Growth will happen. Regular inspection and cleaning is necessary regardless of litigous outcome.
