Default Trespassing Cows. How neighborly should we be?

How many chances will you give a neighbor who can't keep his cows off your land(not a lease) before you call the Sheriff to send out some cowboys?

They are killing protein right now.

In your situation, I'd call the owner and tell him he has 12 hours to remove the livestock or you are calling the sheriff. Chances are, the sheriff will come out and make the same phone call only also threaten fines. That usually works.

Need to check county regulations but it could be you're responsible for fencing them out of your property.

I called my sheriff when the livestock tore down my fences. Then I called the owner multiple times for them wandering on my property but when he didn't seem to prioritize collecting them, I called the sheriff.

Keep a record of their trespasses, too. It might come in handy when talking to the sheriff to show them how patient you've been. But, when the livestock is costing me real dollars by eating supplemental feed I put out, I have very low patience for timeliness.

And I am in a fence out county. The livestock owner is still responsible for damage his stock does.

Things happen. Tree limbs fall, wire breaks

If he ain’t doing anything to repair and is being lazy 3rd time will be enough action he will sell them or fix it. I have a zero tolerance policy for lazy people who won’t take care of their liabilities

Some counties in Texas are fence in. Others are fence out. Better check which you have.

No. Only certain counties. In fence in counties, owner is responsible for damage their livestock causes.

Are there multiple fence issues or one spot that is bad? A quick fence repair could save you lots of headache.

As mentioned many counties in Texas are fence out counties so if you don’t repair fences there isn’t anything the sheriff can do.

We have this same issue up in Oklahoma, we don't have protein out and the cows don't stay by the corn feeders for very long but their crap by the cabin/fire pit area gets annoying. We are trying to be nice to the neighbor since he lives up there and we are the "out of towners". Tricky situation

Bingo. In most cases, nothing a cattle panel or two can't fix. If in fact that easy, just fix it and move on. At the same time, could be an easy foot in the door to more hunting land if you played it right. Known several that took this approach and ended up with some good new spots.

We had an issue with cows showing up and no holes in fence found. Went to run them out and low and behold they ran right to the gate, humm....
Someone may be letting them in.

Sheriff is the call to make.

We had a 2500 lb bull running around our lease for a couple of weeks a few years ago. That was a big spike.

My moms cousin had this problem years a go with a bull that kept jumping the fence. He would call the owner and eventually the owner would come get it. But it kept happening over and over so my moms cousin penned the bull and sold it. He got arrested for cattle theft.

Dang! That’s a hell of a deal for the cattle owner. You don’t have to do anything to get your cattle to auction except open a piece of fence.

If you shoot it or sell the cattle you will go to jail for sure.

Call the neighbor and ask them to get them. If they drag their feet give them a specific time line like 24 hrs.

If it's not still not moving call the sheriff and ask them what the next step would be.

I would not be afraid to mention casually to both that you do not have cattle so there may be things on the property that would be harmful and that you are making both aware.

In the drought that we are in.

If you have grass and your neighbors don't, it will be hard to keep the cattle out, no matter how good the fences are.

How many times? One or two, depending.

Two if the livestock owner is generally responsible with his livestock, fences, and maintains adequate pastures or feed for his animals; if he is readily available for your outreach and immediately responsive to your concerns; and if he takes immediate steps to prevent the intrusion from occurring again.

One If the livestock owner is neglectful with respect to any of the items listed above.

I wouldn’t wait too much longer to call the Sherrif as I would think you would want to establish a record if the problem becomes habitual.

Man I would hate to run cattle next to some of yall. Our cows occasionally get out and we go find the problem and fix it. Our neighbors cows occasionally get into our pasture and we let them know.

Heck we raised 3 long horns for months while the neighbor got his fences in line. He provided the cubes for us monthly.

City boy question here......... If it is the landowners responsibility to build a fence to keep neighbors cattle out then how is it not tresspassing when said neighbor decides it is time to take the cattle to the auction and they have to go get the cattle from the neighbors land?

I guess asked a simpler way if your neighbors livestock is on your land because they didnt want to come up with a way to keep them contained how are those then not your cattle?

Obviously I know nothing about the livestock business.

Was thinking the same thing. Most of the questionable comments are probably from weekend warrior land leasers, not owners.

None of that seems to be happening in this case. The OP is feeding the neighbors cows, and the neighbor knows it and is taking advantage of the situation.

My last message to the neighbor was a picture of the cows eating out of the protein feeder with the message "You should find them here, eating protein". That was last Thursday.
