Angry 10 day demand letter help

This is a question for anyone in law enforcement.

On another thread, I mentioned that we had a contract with a company to rent out our RV. They told us that it was out on a long term rental, and it's been that way for the last two years. They are consistently at least 3 months behind on payment. Right now, they're 5 months behind. Back in March, our contract was up, and we told them that we wanted the RV back, and we were ignored.

We spoke to a LEO friend that said we first needed to send a "10 day demand letter", certified mail, with signature receipt. We did that, and they did sign for the letter. That was on the 18th of August, so we're well past the 10 days. According to the friend, we can now report the RV as stolen, to the Ft. Bend County Sheriff's Office.

Here's where I run into conflict. We have another friend that listed his RV with the same company, and has the same results. He didn't send a letter, but instead called the FBSO and they told him there was nothing they could do as it was a civil matter.

Does the 10 day demand letter change anything for me? Or will I end up having to file a lawsuit against them, to get my trailer back? If the letter does make this a theft, can you direct me to the legal stuff to reference?

Just in case you're wondering, the name of the company is Vakay RV Rentals in Rosenburg. If you're in the market to rent an RV or to get yours rented, stay very far away from these people.

I have a relative dealing with a similar situation. Sorry to say it has been a year and a half. Be ready to spend some money and sit in court.

A copy of the 10-day letter should be provided to the LE agency, and file theft charges. Provide them with a copy of the contract, and wait. Once it's listed as stolen, hopefully, the investigator can run a plate scan on it and generally see where it is. Do you have full coverage insurance on the RV?

you can report it stolen at this point. If you get the run around from Ft. Bend, I'll ask some auto theft people here for a name to call.

And if its the the woodlands, Lets start the Posse now

I think the 10 day certified letter, coupled with the fact your contract ended months ago, elevates the matter to a theft charge. Similar to someone keeping a rental car for months beyond the contract period, and that person being charged with auto theft. Whether you call a FBCSO deputy to your home or go the SO headquarters in Richmond to file a complaint/report, I would have copies of the rental agreement/contract, the certified letter/signed receipt, and any other correspondence like emails, to provide to the deputy as evidence. The deputy can collect these items to include with his offense/incident report, which will eventually be routed to a detective to investigate further. Definitely hang on to the original documents unless the originals are needed during the investigation/prosecution. I hope you get your RV back in good condition, along with all of the back fees you are owed.

We have a copy of the letter, and the signed receipt of delivery. It was mailed to the company, that we had the contract with.

Can you post picture of the RV. There's 3 long term RV parks right there on 762 (2759) where they have several advertisements. Wonder what the odds are that its sitting on one of those occupied? Especially that hidden one in Booth.

I just looked to see if I still had his personal phone number and came up blank.

I have his number and his wife's ... which they use as primary business phones.
Last time I tried to call, it went straight to voicemail.
I called from my boss' phone; guess what! Tiffany (his wife) answered.
They've also blocked both Tina and I on Facebook, after I posted questioning the status of our late payments and location of our trailer.

In his defense, WHEN they were communicating, he seemed more honest than she did.

On the "sweet fleet" page, ours is the Katy.
32' Trail Runner. I know that one is ours because of the white jack. Another renter had put it on a 2" ball, and lost it on Hockley road; then replaced the brown jack with a white one.

Are you getting paid? Receiving rent regularly? From the sound of it you probably don't want it back, except for insurance purposes. Sorry for you having to deal with this and pray you get it resolved satisfactorily.

Tina did call the Ft Bend Sheriff. They told here that she should bring in the demand letter, the signature receipt, the contract, and proof that they have the trailer, and a theft report could be filed.

This will start us on track to get the trailer back. To get the past due rental money, we'll have to file in small claims court.

For a while, we were getting paid. When it went on the long term rental, at first they paid, but always 3 months late. Then it got to where we had to call them, to get them to pay. Now, they're 5 months behind, and won't answer calls, texts, or emails.

Realistically, if they were paying us, this would be a non-issue. At this point I want it back so I can either rent it through some other means or just sell it.

You are going to have to sue them for the money. I'd talk to a lawyer that knows this space before filing for theft.

I'm expecting that.
However, in THEIR contract is says that they will maintain the trailer, except for normal wear and tear. I'm anticipating adding anything above that to the claim.

No, this is a local company that is similar to rvshare.com, except they store the trailer, clean it after each rental, and do standard repairs ... according to their contract anyway.

Send them a certified letter telling them what day it will be reported stolen and try to get it done that way. No trailor report it stolen. May not help but it’s a cheap way to try and get it back so you can evaluate your next step.

Kevin, is the contract with Vakay or with the ultimate renters? Did the rent checks come from the renters or Vakay? I saw on their website that they set it up for the renters, so did the renters then move it themselves to Louisiana from the Woodlands?

Sounds like you are on the right track on both the criminal and civil side of things.

What does your insurance say?


I'm in for the lawsuit. Seems like, if nothing else, they will go broke after you sue. I can't see you losing.

And what did they say when you called from that other phone when she answered?

The contract is with Vakay and the checks come from them as well.
Typically the renter would take the trailer wherever they wanted to use it, but Vakay did offer a delivery/setup service for those that didn't have a truck to pull it. I have no idea if it was ever in the Woodlands OR Louisiana. For all I know it was all a bunch of lies.

We have insurance on it, but they claim to carry a policy as well for potential damages.

When I called from my boss' phone, I was asking about our payments. Back then, they were only 3 months behind. First they said that they had reached their Venmo limit. So I told them to mail me a check. They insisted that they'd get it sorted out and get me paid. A few days later, we'd get Venmo for 1 months rent.

OP - File with BBB It may not do any good for you but it's quick. It may save others from getting screwed.

They only have two filings against them so far. But looks like they resolved them so they did take action after being filed with BBB.

Maybe have a friend rent the trailer, then not fill out the paperwork, block it in, call the sheriff, you bring the title and paperwork, and take the trailer home?

If I had to guess, there is a contract between Kevin and vakay, then another contract between vakay and the renter.

Vakay is probably only responsible for any damage when the rv is in vakays possession. Once it is rented the contract between vakay and the renters probably makes the renters responsible for all damage.

We know how trying to collect money from a renter is going to go.
