I'm sorry, but if a person is on my property uninvited, actively hunting, they are a poacher. I don't have to wait until they kill something.

As to is he a poacher? I am willing to bet that if I get caught by a GW on property I have no permission to be on with a gun in my hand and in camo I will be sited for something serious. Although I have seen to guys walking Hagerman with guns get off with a warning. ( confusion about small game hunt areas long ago )
