Trespasser or poacher

I saw a thread showing some guys on someone else’s property and it got me to wondering.... when does it constitute poaching? Don’t they have to kill something and until they do, they’re just trespassing?

Legit question, I don’t know the answer.

I don’t have any idea from the law standpoint, but in my mind, you ain’t poached until you draw blood.

I don’t dig too deeply into the Parks and Wildlife code but I did not think that poaching was a listed crime. Poaching is a general term meaning to take game illegally, usually on someone else’s property. Probably legally meaning nothing. It is like road rage, Castle doctrine, breaking and entering or many other words that actually aren’t listed in the law. It is just a term or a phrase.

To my knowledge there is no such thing as trespassing. There was just criminal trespass. Whether you have a fire arm or not depends on the level of the offense. For basic trespassing is a class B misdemeanor but if you carry a deadly weapon then it is an A misdemeanor. The weapon enhances the penalty, it does not change the title of the crime.

I thought for a game law violation then you were charged with that actual violation.

If you are on someone else’s property and you have been given notice that you were not supposed to be on that property, it is Criminal Trespass. Carrying a weapon or not only change is the penalty.

If you’re hunting something illegally then you have committed that specific crime such as hunting without a license, hunting out of season, etc.
