I have a niece that is a RN, think she got her degree for a PA as well. Had a aunt come down with breast cancer. It ended up moving to her lungs. My niece said once it gets to the lungs, then it's just a matter of time. 6 months later, she passed.
RBG has cancer in the lung. With the special treatment she's getting, I'll give her a year or less.

Surely there is a provision that allows for the replacement of a justice whose health prevents their execution of duty, even if only a temporary or emergency replacement

They are probably doing everything they can to keep attention and media off of her as long as possible. If this goes on any longer I wonder which judge will stand up and speak out first?

I do not agree with lifetime appointments to the USSC...FOR ANYONE.

But how is she qualified now to be on the court, at that age your mental capacity is diminished, age takes it toll on all cognitive functions, and the brain diminishes. She cannot stay awake during arguments......
Congress should have stood up and recalled her 2 years ago.....

How can she vote on something she didnt listen to the entire arguement?

In good faith, she cannot. I don't think it's her decision to stay in the position at this point though.

I agree. Must be some unwritten code the other judges are adhering to because they are remaining very silent on the issue.

this. I don't wish bad things on her just for her to do the right thing. come to think of it, I'd like for all of congress to do the right thing and quit all this selfish bickering and get to leading our country instead of fighting to be the first one to fill up their bank accounts or win an argument. If RBG leaves the court while Trump is in office, no matter what else Trump does, he will have saved this country by getting 3 constitutionalist judges seated. It wont matter what that DB Roberts does. Can you imagine if Hillary would have been elected and stacked the court with 3 additional liberal judges? The demise of our country would have been set.

Been saying it for weeks now. People underestimate the lefts view is the SCOTUS. The SC is their holy grail. Theyre view is they legislate from the bench. Their #1 worry is not trump in office, it is him appointing conservative judges. They will risk it all to avoid another SC appointment by trump.

I donít think so. I think the Demís return the Scalia favor and delay until after elections so that they can pick a liberal judge.

I completely disagree. Letís make a friendly wager on it. If RBG vacates in the next 12 months another conservative judge will be appointed. Trump isnít going to compromise. This is going to be a huge part of his legacy.

The House has nothing to do with Federal Judge Appointments. That's part of the Senate's responsibility of Advise and Consent... Senate is a better ratio now than when either previous nominee was approved.

Don't want to wish any "bad" on anyone, but I hope she "retires" today so the process can begin immediately!

And, I believe more and more Senate Republicans are seeing the benefit of jumping on the trump train voluntarily instead of being pressed to do so. RBG leaves, Trump will have no problem with his next pick

Is there a certain time frame that the senate can deny/postpone a nomination? Scalia died 9 months before the 2016 election and that nomination was postponed. Surely, there is some sort of rule about this. Otherwise, the senate could just refuse to allow appointment indefinitely if the senate/president disagree.

I am not aware of one. Since the Republicans have the majority in the Senate it should not be an issue.

If anyone thinks that an 85 yo frail women will be able to recover from cancer and surgery to adequately reassume work responsibilities are disillusioned. So there is an article about this as a supreme justice and carrying on duties. I imagine the count down has started.

It was set by the Dems under Oboma (Nuclear Option). BTW, it is the only way we got Gorsuch and Kavanaugh in.

It's working out in favor this time, but I wouldn't assume it always will.
It seems dangerous to me that the senate that can deny a supreme court appointment to an undefined point. Scalia replacement was denied 9 months before the election. Next time it might be 12. or 15. etc. I'd be fine with saying appointments will be postponed within 9 months of a presidential election. No biggie. But, the line needs to be drawn somewhere.

The POTUS's ability to appoint supreme court justices is IMO the most important thing they can do. And, the senate should not be able to block that outside of a reasonable, predetermined time frame.
