Game Warden Question: Discussion at work

Can a Texas Game Warden enter your house and search it without a warrant?

If he reasonably believes that there is an illegally taken or possessed Wildlife Resource contained within the house, yes.

He's state police, so he doesn't have to be in search of wildlife violations. still has to adhere to the same standards/requirements of all other law officers

"Hello I am a texas game warden as well as a TCOLE instructor and thought I may clear up a few things. First off to answer the gentleman’s question; no a game warden cannot enter a home without a warrant or without the effective consent of the owner unless exigent circumstances exist or the game warden is in fresh pursuit of a suspect that’s committed a criminal act. The same goes for every peace officer in the state of texas. The reason behind this is simple. Searching someones house without consent or a warrant is a clear violation of your 4th ammendment right afforded by the constitution (see Supremacy Clause US Constitution Art. VI, Clause 2). "

Game Wardens have the right to search, without a warrant, any property where they believe illegal activity may be taking place.

Wrong. That would be against a thing called the Constitution of the United States.

Any LEO has to have a warrant to enter your home or have your permission.

Not legally no! We are still (barely) free people and have a Constitution that protects us.

If that were case, they could make EVERY LEO a game warden. Then to hail with the Constitution

                          Thank you!

Some GW might act like they can to get consent. But what ever they find will get tossed in court if you dont consent and they search without a warrant.
