I'm one of the seemingly few men that had a great MIL. She was taken too soon, and is missed. Prayers up for yours to recover quickly and fully.

One of my job responsibilities where I work is putting out notices for possible hazards on our property (which are many across the nation) and they are very particular about the wording we use for liability purposes. They also require that if they are temporary hazards or fixable, that the hazard is repaired and the notice is not left out as a long term solution. Otherwise, it's easy for an attorney for someone who gets harmed to say they knew there was a hazard that had a permanent solution and did nothing to correct it. I'm not saying it's right but it's the world we live in. And my employer has a entire building full of attorneys across the street from us.
The caution tape in front of that tile is that kind of solution. The difference in height is easily remedied with a transition solution. (Yeah I installed flooring for 27 years too) so this tape could be seen as a temporary solution. So the question is how long has it been "temporary"?
Again, I'm not saying lawyering up is necessary or the right thing to do but most of the world is looking to do just that and Lowe's knows it.

When our son was injured His doctor told me “you may need to consult an attorney “. I said “your right. They need to cover his medical expenses”. His response while looking puzzled, “I don’t think you understand. Your sons brain has been irreparably damaged. He will walk and talk but no one goes through a two and one half hour grand mal seizure and comes out unscathed “.
So no my original intent was not to make bank but cover ours sons medical expenses for what I thought would be a bump in the road. Little did I know that it would alter not only his life but ours as well. No amount of money would ever be worth him becoming disabled.

IMHO, if Lowes put caution tape down, they knew there was an issue.

Someone earlier made a stupid(yeah I said it) post about if there was a sign saying don't touch high voiltage...would you sue if electrocuted...

I was at at restaraunt in Austin a while back and the restroom hot water was "SCALDING" hot. I told the manager and he said it is tied into the dishwasher and they had signs that said water was hot. WTH

I told him a kid could severly burned. I about ripped him a new one and they are not in business anymore.

I agree there is no cause for a lawsuit. Any place there is a transition from one floor type to the other is why the tread tape is there.
But she'll get paid. Lowe's will do it as to not have to go through a lawsuit.

True, but most of it was because it went from a cement floor to a tile floor which meant there was a transition in the level of the 2 floors. Heck, there are a lot of people that could trip and fall in this type of transition.

You’re right. I will never understand why someone will look for someone or something to blame. There are known risks in life. Tripping and falling is a known risk of walking. Do you need a sign everywhere to tell you that? Not every gun produced has a safety. Do you need one to tell you there is a risk? The lady tripped and fell.....why is it Lowe’s fault? At what point do you blame yourself for not paying attention?

Either replacing the bad tile or heel grade caulking installed would have prevented this.

I don't know if that Lowes has a busted tile that is hazardess or not.

I can’t be more calm, sitting on the couch drinking iced tea, watching deer hunting.

You be careful out there. It’s a dangerous world. Make sure you turn the hot water on and feel it first before you just dive on in and start washing your hands. Some water is hotter than others. Also soup....soup is super dangerous if you don’t blow on it first. Hot pockets are the devil!! They seem safe until you bite into them.

Look for signs everywhere of all the risks that lie ahead in life. And don’t worry, if you get hurt there will be someone to hold accountable.

You trip at Lowe's, Wal-Mart or the likes and you ONLY sue for damages?


All your other writings have merit. If this and that. I was commenting only after saying if the grout is level with the tile it's not Lowe's fault. If it's really a trip hazard that many people trip over then yes Lowe's is negligent. In that case they caused pain, suffering etc..and will be sued for more than her medical bills.

Reported for jury duty a few years back. Seems there had already been a trial to determine fault and we were to be on a jury only to determine the pay out.

First trial found a store guilty because some old gal walked right past a "Caution - Wet Floor" sign, slipped, and fell. Another customer had spilled something, an employee placed the sign, and was going after a mop when the old gal fell and broke her hip.

I got booted in voir dire when I told the lawyer I wouldn't give the old gal the time of day, let alone any money.

Just an example of a world full of people who take no responsiblity for their own actions.

My daughter is an archetect and designs buildings, office space, retail stores, apartments, etc. Showed her the broker tile pic. She says that Texas building codes require all flow elevation changes (carpet to tile, tile to concrete, etc.) to be less than 1/4".

That pic certainly looks like less than a 1/4" change.

That pic certainly looks like less than a 1/4" change.
Doubtful. Most tile is thicker than that on in its own, add thinset and it's definitely over.

My grandma drags her feet in her old age, she would’ve face planted as well. She falls weekly, getting old stinks.

On another note, my fathers stepmother who died 10 or so years ago, was hot in the back by a forklift in Sam’s club. She was always evil but after she got pummeled she was even worse. I think she had four back surgeries, to my knowledge she never received any sort of compensation, died broke as a joke. Sam’s oughta still be paying me for having to deal with her cranky butt.

Doubtful. You can see where it’s been floated to grade. I bet less than a 1/16” if that.
