If it's a fake phone then contact Apple with his info, they will handle it. They might also like the phone and give you something for your trouble.

What's crummy is that you can't even really sell it for parts because its not even an apple phone. It's basically a pieced together bootleg android with a custom ios installation. Sorry man. This sucks.

This is my buying a used iphone checklist:
1. IMEI and call check: Always meet at AT&T store (my phone carrier). The store employees are glad to check the IMEI number to make sure it's not blacklisted. And make an outgoing phone call and incoming call to the phone WITH YOUR own sim card.
****VERY important to make sure it's either an unlocked phone or able to be used with your carrier. You'd be surprised how many people have been duped into buying a phone that they worked in every way but checking to make sure their carrier sim card could use the phone and it was locked with another carrier. ****
2. Water Damage Check: Then I check the water mark sticker inside the sim slot to check for water damage. It's white if there is no damage, and almost a neon pink if there is water damage.
3. Physical and operational check: If it's a newer iPhone, make sure the haptics work properly and respond properly to touch, make sure the front and rear facing cameras focus and operate properly, I also check for dead pixels in case the screen was recently replaced with a non-apple screen.
4. iCloud check: Then check iCloud status to see if it's locked by asking the seller to log out of their account.
5. Once it's good to go, do a full on reset on the phone and exchange the cash or whatever you're exchanging.

I might be missing some things that other people look for, but I've been lucky so far and this list has always worked for me. If ANY of the steps fail or don't pass satisfactory, then I stop the checklist and walk away. There's always another iPhone for sale.

can u just not use icloud? I don't activate Iclould on mine and it works fine. I back it up every once in a while to iTunes on my computer. I can DL apps in App store just fine. I don't like storing my info on a cloud somewhere...lol

Because if you make a knowingly false statement to sell something, it is listed as “deception” in the Penal Code. Deception makes it without the “effective consent” of the owner of the property and therefore Theft under 31.03 PC.

Let the buyer beware is an old adage that holds true however it isn’t the law.

I just saw something about a used phone that was "cloud locked". He could make and receive calls but can't sign into the cloud to download his existing apps and contacts. The last owner did not sign out of the cloud on that phone. Apple suggested he send it in so they could fix.

If you want to see it in words.....

Too many words in the PC (especially under Theft) but I will try to cut it to the relevant parts of theft.

This is the important parts of the theft law in this case.

Sec. 31.03. THEFT. (a) A person commits an offense if he unlawfully appropriates property with intent to deprive the owner of property.
(b) Appropriation of property is unlawful if:
(1) it is without the owner's effective consent;


The seller appropriated (took) the $800. Was it lawful? According to the PC it is unlawful if without “effective consent”. So what is effective consent?

Sec. 31.01. DEFINITIONS. In this chapter:
(3) "Effective consent" includes consent by a person legally authorized to act for the owner. Consent is not effective if:
(A) induced by deception or coercion;


So we see here that consent is not effective if it was induced/gained by “deception”.

What is deception?

Sec. 31.01. DEFINITIONS. In this chapter:
(1) "Deception" means:
(A) creating or confirming by words or conduct a false impression of law or fact that is likely to affect the judgment of another in the transaction, and that the actor does not believe to be true;


I don’t think we need to go any further down to list in this case to show deception. The seller made a false statement as a fact that would affect judgment.

The OP consented to the transaction of buying an Apple iPhone 11. It was not effective consent because he was told that it was genuine when in fact it was junk. That is deception.

Deception negates effective consent and with no effective consent, it is theft to appropriate property.
