Don't change the form or function of the brace and you can do whatever you want with it. If you fill anything in, add or remove anything that would change the way it's used then you have changed it into a stock and you have a short barreled riffle.
Shouldering the brace is considered "misuse" but it does not change the intended use or design of the weapon. So, firing it occasionally or accidentally from the shoulder is not a criminal act. However, if you build the pistol with the brace with the intention of firing it from the shoulder you have created an NFA item and would be in violation.
Me, I just had a pinned and welded 14.5" rifle made. Short enough for me and I don't care who sees me shoot it.
I have wondered about this. What, if anything, happens when you put a scope on an AR pistol that can obviously only be used when the gun is shouldered?
