I went thru every administrative process they had all set up for the big insurance company’s. If an insurance company is found to be in violation of the wc protocol they can be assessed a fine for their wrong doing but it goes into a special fund, but not for the person that was wronged it goes into a fund for them to payout penalties back to the Board. I did a lot of case law studies and laws that were passed even one of the administrators told me after a hearing you should be an attorney, I said “I have too much pride to lie to people as I look them in the eye”those policies you speak of were lobbied by lawyers and yes most politicians are liars I mean lawyers, and like all big business they have deep pockets. I am grateful to be alive and not in a wheel chair but I’m not the same person can’t put in for disability cause I have a pension.or any other benefits

    Best I can tell from this is you tried to claim on your personal PIP, and your insurance company pushed back saying while on duty your employers insurance was covering you, not your own. The fact that the department’s work comp insurance covered your medical bills and salary reimbursement only added to their case. If your personal insurance would have thought they were covering you while on duty as a motorcycle cop, I’m positive that you would have paid much more in premiums.

      I mispoke about the pip you are correct I did get my 2500.00, it was my under insured/uninsured policy I had to file suit to get them to pay me . I’m way passed calling people names I’m just stating that if it’s such a money losing industry how can they afford all the tv spots? Not mad at you guys that sell it ,just stating that the industry has deep pockets to get all of these laws passed for that industry to not give HONEST claimants what they pay for. Lots of insurance fraud out there but on a case by case review why so much red tape? Kinda like car salesmen !! I just want a straight answer from someone without numbers that show how poorly the industry profit is ,because all figures can be made to fit any circumstance.

        I had lots of disability insurance because of my profession, I was left by workers comp with a 45,000 medical bill for a torn rotator cuff that they and several dr.’s even theirs said was due to this wreck. They (and I say all insurances) involved kept passing me from dr to dr to say I couldn’t have been injured on a motorcycle accident, they spent more on attorneys and dr.s than what I believe would’ve cost to get me back to work. It’s all the laws in the industry that folks need to be aware of they’re not there to help folks collect they’re claim. I had to pay an attorney to explain to workers comp and my own insurance about what NHTSA says are injuries from a motorcycle accident, guys so smart I asked a w/c attorney does your child wear a bicycle helmet? He said yes why . I said I wore mine and still received a closed head injury (TBI). Not mad just speaking about my experience, look up workers comp laws for first responders or any other profession and read the outcomes. My own insurance company’s attorney apologized for what I went thru after the litigation was settled and I got my piece After attorneys fees . She said this out in the parking lot and thanked me for my service.

          I feel like I’ve been giving you straight answers all along. My heart goes out to you for what happened. I have my own thoughts about Uninsured Motorist (too complicated to explain here, but I don’t like it), but I’m glad it worked out for you.

          As for the TV spots, I hate them too, again I’m commercial, not personal, but believe it or not insurance doesn’t work unless the deck keeps reshuffling (keeps it competitive). With a handful of companies who cover some 300 million Americans means that even at 10% market share you’ve got 30 million customers at let’s say a 20% loss ratio (profit). That’s a lot of money no doubt to advertise. I mentioned earlier how the appetites change depending on what they want. If they can move the needle even 1%, that’s an additional 3 million customers.

            You have and I never said you haven’t , what I did say was workers comp is my self insured employer riding on the coat of big industry to not pay as they should for real injuries, I’ve seen lots of fake claims in my 30 years as a Leo. I see so many people that slip and fall or are depressed and can’t work so they abuse the systems to get something for nothing, but I loved what I did and I’d still be there today if they had just fixed me .We should be able to speak as civilized men not school boys calling each other names because we disagree , I give thanks to God daily that I’m not in a wheel chair or dead but when your 3 year old and 6 year are looking at daddy laid up and wondering why the doctors can’t fix ya it did upset me. But that was 5 years ago . I walk a bit slower can’t remember everything I used to from the TBI but I’m above ground.... [emoji120] amen

              Here’s the sad truth you don’t want to hear. I insure companies to protect THEM from people outside or even within their company. The company they’ve spent 30 years building can go up in smoke with one lawsuit. Insurance companies want to take care of you as the injured employee, but only as it protects the company (county in your case). Just like Your personal insurance is there to protect YOU, your house, your car etc. and will only take care of the damage to others as it protect you, their top priority. Same thing.

              Btw: I talk bad about attorneys, but they keep me in business. Without wolves there’s no need for sheepdogs.

                  It’s an imperfect system. That we can agree on. It’s been forged over 500 years, so we as fellow bow hunters won’t fix it, and even if we did, who would listen. I’m sorry you feel like the system didn’t work for you, but thank god you are alive. I’ve given a $2million check to a grieving widow. It sucks because the money doesn’t replace their loss. But accidents happen, and knowing I helped that family move on with a little financial comfort is all I can do.

                    I hear ya I’ve buried many a brother the city the dept use the publicity as political tools parading widows and orphans to sporting events with the news media there . But when it’s all said and done we have to lookout for each other, my dad did 31 years on the dept as did I ,my brother did 32 and my younger brother still in the BCSO K-9 unit. Like my dad said understand what you’re undertaking
