I believe its this but the pic isn't clear or close enough. Like someone else said, pick a piece of it, crush it, and smell it.

Does rosemary grow upright? Leaves look too broad to be rosemary to me but I'm only familiar with the trailing kind.

Run your hand through it and smell; you will know if it’s rosemary.
