Trespassing evidence on social media?

I recently had a nosy neighbor I did know previously pop up on my radar screen. Just a weird confrontation that made my spidey sense perk up.

I mentioned the lady’s name to a couple of neighbors. I don’t do facebook or instagram or any of that. Both neighbors sent me pictures this week from this lady’s social media pages of photos she has taken from MY back yard (I have a great view).

Lady is a realtor and has an aggressive personality. What would you do? Can you file criminal trespass on someone based on their own social media posts? Should I file a complaint with TREC? As a realtor she should know better. The pictures go back 4 years and show a history of habitual trespassing.

I'd start with the TREC and file a complain with your local police agency. Let them contact her and hopefully will set her straight.

Post "No Trespassing" signs on your fence. Send her a certified signature required letter telling her to stay off your property.

Maybe contact the lady directly and ask/tell her to stay out of your yard? Send her a registered letter telling her to stay out of your yard?

Have you spoken to the neighbor to ask why she was in your yard? Is your yard fenced?

edit: I reread your post and you did say you had a confrontation with her. What did she say?
What does it mean that you did know her previously?

To answer your question without your further clarification, which you don't seem to want to provide, I would ask her what she was doing in my back yard.

Well, not be a contrarian, but, I'd keep the legal/lawyers OUT initially.....

I'd go knock on her door.....BE VERY NICE.....talk to her about the situation then, if she denies having habitually trespassed, I'd very calmly and quietly pull the pics/evidence out..... I'd also record the entire meeting, at least audio.....it's unfortunate that you've got to do that, but, we're living in a pretty jacked up world today. A person is a fool if they don't protect themselves as much as possible in situations like this.

If she's STUPID enough to deny the obvious

The confrontation involved her husband pulling a gun on me and threatening to shoot my dog because my dog was aggressively sniffing his pant leg. The guy was screaming obscenities totally nuts. When I asked his name, he screamed,”F U is my name!”

Sheriff was contacted and the husband is a known hothead to them. I was told the sheriff went and talked to him.

I don’t want to go over there and knock on the door knowing there is a crazy guy with a gun there. She eggs him on and encourages him.

Nope, don't go over there en light of that information.

See if you or the other neighbors can save the pictures she took along with screen shots of her social media posts. Possibly contact the sheriff but at least keep that information in case any further incidents occur.

Scratch the advice I gave above......except the part about recording interactions with these known idiots....

I'd certainly start, very quietly, gathering up the evidence of their actions/idiocy.

Also, I'd place a few retired game cams around the perimeter....

In that case, I would telephone her to ask what she was doing in my yard.

Is your yard fenced? Is is it, by chance, listed for sale, and she was checking out the yard for a possible buyer?

Either way, I would want her to know that I knew she was in my yard, and I would want to know why!

Then I would contact the police and show them the evidence...maybe ask for a restraining order, especially in light of the previous confrontation from her husband.

Sounds like a good way to get caught up in something you don't want to with a crazy lady and unhinged, and likely very jealous, husband.

I'd pass that info onto the local police and let them handle it.

And record everything

Put up the signs and try to get your hands on those posts as others have stated. and just remmeber to stay safe. i know that sounds obvious but they are obviously off their rockers and you need to be extra cautious when interacting with them. good luck

First post i would have gone over and asked her what she was doing. With the follow up information id get everyone i could involved police, trec, lawyers. I dont deal well with nut jobs.

I would not contact/confront them at all. Let the police handle it.
Call the police (not 911) and ask what can be done with the pictures/evidence you have. If that is enough to move forward, I would have them Trespass her.

I'd alert the law and have them serve her with a warning.

Facebook will sometimes Geotag pictures. In short I would bet there is a way to get the lat and long Geo coordinates from the pictures if there is a debate on where they were taken.

Is she using the pictures on her listings? If so then get the Real Estate Com. involved they will shut her down quick. Then get LE involved and be prepared for a confrontation.

The house was never on the market. Never on MLS, never a sign in the yard, nothing. Some of the pictures I have been sent have dated posts, most recent I could tell for sure was September 2018.

We are lakefront, our yard is not fenced. She is using the killer lake view sunrise photos to promote her real estate business.

I would not mind my neighbors using my yard to take pictures for that purpose, but it would have been nice if she had asked first. I would not consider that trespassing for ill intent, and I would not escalate it with the law knowing what you now posted (I wish we could get the whole story when advice is requested). I suppose the previous encounter with her idiot husband influenced your feelings about her taking pictures from your yard. I would just call her and ask her not to do it anymore. Be neighborly.

I would call her and tell her next time she wants to use your killer view to call and ask permission because her husband is a known gun happy nut job with the police and all so don’t want the neighbors to think You have lowered your standards in women

Step1: Give her notice of no trespassing.

If she is marketing your view...potentially deceptive trade practice.

As a RE Broker I would give her a call first. If that becomes hostile then I would call the TREC and file a complaint and do the same with the local LEO
