I retract my incorrect statements after considering that he is looking to the left so his head is distorted in the picture. I believe that is for sure a badger.

Badger is the only thing I think it could be. I think maybe because the tail is up that its throwing some people off.

Usually the only way I see them is when they do pull there tail up. Usually look like a small piece of earth moving cause they are so low to the ground. And it's usually at dawn or dusk. Fun little dudes to watch. I was always told not to shoot them cause they kill snakes.
