Default Hunting license question for TBH legal staff....

I have always wondered this, what’s the TBH’s legal staff and opinion experts thoughts on this. Assume you are up at your place, lease or club and you hunt morning and evening. After dark you decide to run into town for a Subway or whatever. You leave your license in your camo pants back at camp. Waiting in line with you at Subway is the local county GW. If you started chatting about the hunting and the fact that you hunted earlier that day, could he get technical on asking for your license. Said another way, when does one go from hunting to not hunting? It’s all hypothetical and this scenario has never happened, just curious.

You have to have license on you WHILE HUNTING.

When actually hunting, or fishing public water, you must possess the valid license. You don’t need it at the grocery store, ballpark, etc

I guess technically he could ask to see your hunting license however, he could not cite you for not having it because you are not hunting at the time.

Thats just to check and see if they should come back later and check who all IS hunting. 4 guys at camp, 3 with a license. He'll likely be back to check the guy with no license.

I think I have watched to much Lone Star Law! Lol. I never carry my license around. It stays in my camo bibs or whatever I am hunting in that weekend. So I thought I would ask.

Correct but the conversation usually starts with, “have you been hunting” or “had any luck”. Or some sort of question that would illicit a response which would lead the warden to reasonably believe that you have been hunting or simply get you to say that you’ve been hunting. Now chances are that your license will be in camp, not at the subway sandwich shop in town or not back at home 4hrs away. At this point you better be able to produce your license or you will be cited for hunting without a license.

My crazy Redneck uncle had a major uproar on the trinity river one time. He was heading down the river with rods in the boat but not fishing yet. He gets stopped by GW and asked for a fishing license he refused because he said he was not fishing and had no fish in the boat. This turned ugly and 3 other GW’s showed up and threatened jail he said no problem. In the end they let him go and he never showed it.

He had his issues with the GW’s for a ticket that he did not agree with a few months prior.

Hunting is ACTIVLY trying to take an animal. You are not required to have HL because you are wearing camo at Walmart. If checked in camp sitting around fire you don’t have to have on your person.

If checked in blind (hunting/activly trying to take an animal).... your gonna need it

Makes sense to me. I am sure there is at least one person on here that could share a story that he was asked to produce his license under the “camo in Walmart” scenario. Anyone?

I have been checked in the field, in camp, and on a public road in DCNF. They CAN check you any time and anywhere if they have reason to believe you're hunting or fishing.

Not everyone who wears camo of some sort out in public has been hunting so no I dont think anyone has been asked to produce a hunting license simply for wearing camo...

I don’t know? I am sure at some point a GW on a big hunting weekend someplace in Texas saw some ‘necks in camo kickin it at the Sonic and based on the cammies asked them “how the hunting was” and when the ‘necks confirmed they were hunting by answering, they were asked to produce their license.

A group of us was a motel in Littlefield Tx a few years back and the game warden's banged on our doors and wanted to see our license. We had our license. Just curious because we were not hunting. Always wondered what they would have done if we didn't have a license. Yes we had dead birds in the coolers. This was a Saturday night after opening day.

There wasn't but about 6 birds and the hunters that shot them went out with the wardens with their license. All was good and then they came back in and wanted to see everyone's license. Just found it odd. Not gripping at all.

From a different angle. If you have a current hunting/fishing license but it is not on your person and you are checked, the GW will have the ability to determine if your licence is current. At that time, if your are actively hunting or fishing, they would be within their rights to issue you a summons.

Howeverr once you go to the local courthouse or JP office, I'd bet 9 times out of 10 it gets dismissed with court costs.

This was at a motel room about 9pm at night. It's no big deal and they were very nice. Just curious after the hunters that claimed the kills and produced their license and were cleared they checked all of our license inside our rooms and hunters education courses. We were not hunting at 9pm.

I guess if you have the right Rooster Lollipop game warden and you run you’re mouth at the wrong time they could ask you some uncomfortable questions. Depending on what you were jawing about.

But wearing Camo in public is a god given right. As is being unshaven, dirty and smelly

Amen! Thanks for all the input. I am seriously recaliprating my respect level for the geeen cops based on all the numbskulls they deal with. Is there any wonder why some may come across as “Rooster Lollipop”? But that being said, I have no interest in being tread upon.

The only one and only time I have been cited I was hunting a pond with my future FIL. I was 16 and he said I didn't need the federal duck stamp. He breasted the ducks and put them in a black trash bag. As we walked out there was a truck at the gate about 200 yards away. He hid them in the brush and covered them with leaves. We get to the gate and the warden asks if we were shooting ducks. We say no. Wrote us a ticket for "being in the field with a gun hunting during duck season". We made it about 15 miles down the highway and a warden came at us, flipped around and threw the light on. Pulled over and the original warden came to a sliding stop behind us with the trash bag in his hand. "Didn't shoot any ducks did you!!!!" Got another ticket for not leaving a fully feathered wing on a duck. I will never forget those words and will never ever do anything to be cited again.

We were checked by a federal warden at a national wildlife refuge this past teal season. He was checking people as soon as they pulled up. We were legal ,but I asked him what if someone pulled up without his license. He said you would get a ticket even though you haven't hunted,because if he hadn't been there you would have gone hunting. He did say it was a pretty common ticket to write at 4 oclock in the AM. He said an unplugged gun would get you a ticket at that time too if your gun is unplugged.

Why would you be cited in town "not hunting" if you don't have your hunting license with you? They can call and verify a license, and being in town ain't hunting.
