    Criminal court question?

    Ok I spent half a day in court yesterday and I observed several things that answers some of my questions on why so much repeat (boomerang thugs) criminals exist.

    But something I witnessed twice seems new to me. Both of the cases involved unlawful immigrants.

    The defendant appeared with council for numerous charges including drug, domestic violence etc. The prosecution had worked out a plea bargain with the defendant. The defendants council would then ask for time to review the plea bargain as immigration would need to approve the plea agreement.

    Almost on cue the prosecution would immediately drop all charges. Almost as if the state did not want to waste time with the cases like that. Is this something that has recently started due to change of administration? Or has it always been going on?

    Sounds like the local court doesn't want ICE deporting anyone. Must be nice to be an EWI, do whatever you want and no legal consequences. He can go home now and finish beating his wife.

      Hard to say without knowing all the facts, which we may never know. Last month, had a case similar to this where the DA dismissed the charges on a family violence case. The man was handed over to ICE for deportation though, and he is gone. But the case was dismissed more or less because he didn't do what he was accused of.

      Had another case this week dismissed, but he was not an illegal. I won't get into the details, but suffice to say that a woman spent almost 7-months in jail awaiting trial because of the complaint that was made against her. When it was all said and done, the complaining witness, during an interview with me, said that he had actually dreamed the entire episode and that it was "so real," he reported it to the police and they acted on it and made an arrest.

        I'm not hackin' on ya though I am going to make a point; the law is simply black and white. Illegal immigration IS a violation of Federal law. Details of other crimes he may have committed are just that, a separate and distinct set of charges that should be filed against the loser in question. Those charges should have no bearing on whether an alien is deported or locked up for Federal crimes. He should serve his time here for the domestic violence and the lesser crimes THEN he can get the free bus ride home.

        If I were in Congress, my plan for stopping illegal immigration would be rather simple:

        1. Cut off ALL benefits to those not citizens of this Country. That is to include education.

        2. Two year mandatory imprisonment for the first illegal entry violation. Then, a free bus ride home.

        3. 5 year mandatory imprisonment with hard labor for the second illegal entry violation. Bus ride home.

        4. 15 year mandatory " " " " "

        5. If captured already living in the Country illegally, two years imprisonment. Free bus trip home. We are not separating you from your family, you can take them with you...they aren't citizens either.

        Let that drift through the winds of Ol' Mexico and see how freakin' full our emergency rooms and welfare offices are then. We won't have to worry too much about the court system.

          If only it were "Black and White."

          What might would fly and get prosecuted in one county would never get past the intake attorney in another county. Last week I was at a "rural county" with one attorney and we were interviewing a client. The client finally agreed to a six-year prison sentence to avoid trial. During that same week, in the DFW area, same circumstances, and I mean almost identical, that client received probation for their charge.

          Neither one was here illegally, but just an example how its all gray.

            The Law itself IS black and white. Those prosecuting it often times allow politics and ideology to stand in the way of performing that task. Granted, sometimes games must be played in order to gain what is best for society. I get that and, that isn't what we're discussing.

            This is my real life example and what has really jaded my view on the matter; a family member did things to my child. We called the police. He admitted doing these horrible things. Cops did not arrest him because "he was remorseful". The D.A. (a Republican) was in the re-election fight of her life and "wanted slam dunk convictions and didn't want to go to court with he said-she said squabbles...". Thus, she did not even file charges against said family member. HE FREAKIN' ADMITTED IT. In the end, she lost the election and we have a new D.A. We are working on getting charges filed with the new D.A. I'm not holding my breath.

              That sucks. I have worked those sort of cases, on both sides, and EACH AND EVERY TIME, the suspect has been arrested, OR at least referred to the Grand Jury. I could go further into these, but it would be a long, long post.

                No need to elaborate. Everyone involved in the case aside from the sorry A cops in this ordeal and the now unemployed D.A. cannot believe how this has turned out.

                  Watching various more liberal speakers talking about unlawful immigration on these news sources. They are really starting to push the narrative of sanctuary cities having less immigrant crime than non sanctuary. They only use the term immigrant.

                  Two me the failure to prosecute and the dismissal of prosecution has an impact on the stats they are choosing to cite.

                    True that. If the crime is dismissed, there was no crime. Easy to stack your own stats.
