Buttstock or Pistol Brace?

Can anyone enlighten me on the SBR and pistol classificstion?
I understand the gest of it, but how is the below legal? When you use a brace as a buttstock and fire from the shoulder is it still a pistol? Pretty sure I’d know what the ATF says.....

Pretty sure you don't since the ATF as already came out and said you can shoot the brace from the shoulder and all is legal.
