Default Lease Issue

Hipothetical question. On a lease for the first year. 12 guys. Guest are able to come and hunt if member is sitting with them. We Have pics of a certain species of animal that is off limits per land owner. A member has a first time guest today (family member) who shoots this animal. What should be done? This could get us kicked off a really nice place. Not happy.

Possibly buy 2 animals of said type and talk to landowner??? Either way, he's off lease...we had a guy several years ago who had 1 buck tag, and 2 guest hunters, and I heard shot after shot, and after the final morning hunt, they didn't come back to camp and left directly afterward.

Elk?? The guy comes in as a guest and kills an ELK?? Is place high fenced, or ??? This could be a big money screw up..... Not just kicked off, but ought to be a financial penalty, too. Thought maybe we were talking a fox or javelina or axis. This is serious and he needs to know he possibly screwed 11 other guys out of a lease....

Wow...!! Do you have decent numbers out there ? Lease member should not have let the guy hunt alone. Landowner may require replacement cost for the animal.

We only had 3 on camera. There is talk of him paying for another one. My opinion is he needs to go. This was the easiest hunting rule to follow (don’t shoot the elk) and he screwed it up.

That’s the reason I don’t allow guests on our ranch period! Never understood why people pay for a lease to bring guests up and ruin it for everyone!

Don’t sound like OP is 100 %certain the elk was killed by said guest. Hypothetical won’t stand up in court...but the landowner can get rid of you all for mistrust.

Agreed...an ELK??!

I too was thinking axis or maybe even a black buck...but an ELK??!

If I'm LO...he gone & I'm looking into several legal options.

I manage our lease and meet with the guys before every season to make sure we all understand the rules. The rules help us maintain a great lease and a good relationship with the landowner. If one of the guys intentionally or consistently does something that goes against what we've agreed on I'd ask him to leave. The rest of the group is counting on me to maintain a good place to hunt and are all paying dues to do so.

Conversation probably went like this: You can shoot anything but the big 10 or 12 pointer...guy counts and sees the deer (or elk), since he's never hunted before, has 14 points and blasts away thinking he just set the record!!!!

We have elk on our lease , the land owners said they don't want the elk on the property due to the damage they do to our fence, well one guy has shot 5 this year,our land owners are PO' D he was a game hog ! And I really don't know what to say about it when asked " I didn't want to rock the boat " but my opinion is boot the " sob" I would say the same thing about your situation " bye bye don't let that gate hit him in the *****"

why would you say to boot the guy that shot the 5 elk?

He didn't break a rule. The LO said that they didn't want them on and now they are PO cause he shot 5? That's bull****.

As far as the OP- Your guy should be gone. he broke a rule

Don't ASK him to leave, TELL him he is off lease and MAKE guest pay restitution for shootin animal that HE KNEW NOT TO KILL. Call gw and LO and tell him what happened before you all get kicked off for an ****&#! member not doin what he was supposed to do. Better to b up front than not say anything cause that could get all of you kicked off also.

If your group doesn't come clean and get in front of this, with the LO, you're all gonna get the boot. IMO I'd say that it's a given that the member is GONE and also that he/guest (or your group) is paying for a replacement elk. I'll be curious to see how y'all handle it, and the outcome.

Lease member should be told to pack his S**T and never come back! Can't follow simple rules has no business being on the lease!!! I would talk to the land owner and let him know what's going on to make sure you don't get kicked off as well!

As a current lease boss, the member would be asked to leave if my landowner had personally put that animal off limits and it was communicated to him.

The member should have to leave the lease. This is the reason I like the rule of "no guest" because it appears to always get abused. Especially when no one is around from my experiences.

It seems like it would be pretty difficult for a landowner to overlook or not notice a missing elk from his place. They are pretty big and stand out pretty well. You might not have to worry about it for very long.

And if by some chance he doesn't, the it becomes a matter of doing the right thing and owning up to your actions. I not sure I would want to be on a place where a man is so ready to cheat lie and steal all for a set of antlers. If the person who didn't sit with his guest doesn't man up and remove himself, I would go so I didn't have to be a part of that crowd.

Life's too short to get caught up in that kind of nonsense IMO.

In my opinion he's gone. Even if he buys the land owner another elk, that seems like a pretty easy rule to follow; don't shoot the elk. There is no mistaking an elk for anything. If you said it was a certain 10 pt, I could see some "maybe" making a mistake. But an elk? To allow his guest to shoot the elk (he should have said it is 100% off limits) is disrespectful. In my opinion he needs to kicked off to show the landowner your group will not tolerate rule breaking.

I'm 99.9% certain no one would ask someone to come hunt on their lease that is not a friend.

If the landowner isnít involved yet, they should be. Shooting a nubbin buck thinking itís a doe is one thing. Shooting a animal that was off limits sound like a fast way off a cool sounding lease. Guest that shot the elk should reimburse the landowner of fit, member who brought the guest should be off the lease.
