Judge awards $6.7 million to graffiti artists whose work was destroyed to build condos


(CNN)A federal judge has awarded $6.7 million to 21 graffiti artists after their works were destroyed in 2013 at the 5Pointz complex in Queens, New York, to make room for luxury condominiums.
US District Court Judge Frederic Block made the award Monday after a jury ruled in November that Jerry Wolkoff, the owner of the buildings that comprised 5Pointz, violated the artists' rights under federal law.
Eric Baum, an attorney for the artists, told CNN that the decision is "a triumph for artists all around the country."
"The cultural significance of 5Pointz and the value of the aerosol art created by the 21 plaintiffs has been recognized as fine art. It is now clear that the federal law protects the dignity of the artist and ensures that their artwork is treated respectfully," Baum said.



The law, known as the Visual Artists Rights Act, affords legal protections to artists whose work meets certain requirements, whether or not the artists own the work.

5Pointz, a warehouse complex in the Long Island City section of Queens, was a street-art mecca that drew visitors and artists from around the world. Wolkoff had allowed artists to paint murals and graffiti on the buildings he owned since 2002 and over time, the location evolved into a New York City cultural landmark that appeared in tourist guidebooks.
The complex took its name from New York's five boroughs and also was used as a filming location for music videos, movies, TV shows and various commercial photo shoots and fashion shows.

Jonathan Cohen, an artist who had worked with Wolkoff for decades as a volunteer curator of 5Pointz, oversaw the growth of the project and conducted over 100 school tours each year.
"5POINTZZZZZZZZ 4EVERRRRRR!!!!" he wrote on Instagram Monday after the award was announced.
The lawsuit stemmed from the events of November 19, 2013, when almost all of the artwork was abruptly painted over in the early morning hours after Wolkoff revealed plans to redevelop the buildings with high-end condos, retail space and artists' studios.
Wolkoff told CNN in 2013 that he decided to paint over the walls because the building would take several months to tear down and he didn't want the artists' work to be ruined in the process.
However, the artists argued that Wolkoff never warned them of his intention to paint over the artwork prior to the buildings' demolition. They said Wolkoff denied them the opportunity to remove and preserve their work, calling his actions "gratuitous, willful, and malicious," according to court documents.
Neither Wolkoff nor his attorney, David Ebert, have returned CNN's request for comment.
Each of the 21 artists will be individually awarded amounts that range from $75,000 to $1.3 million, according to court documents.

In his decision, Judge Block did not argue with Wolkoff's authority to demolish the buildings he owns. But he took issue with his decision to whitewash the art without prior notice or regard for the artists' ability to preserve their work.
"The shame of it all is that since 5Pointz was a prominent tourist attraction the public would undoubtedly have thronged to say its goodbyes ... and gaze at the formidable works of aerosol art for the last time," Block wrote. "It would have been a wonderful tribute for the artists that they richly deserved."

You can get a start next month. There's a graffiti contest, i believe in Saginaw (maybe Haslet), in March. I think the 17th. I'm planning to go to take some pics of the evolution of the pieces during the day. Should be fun.

This is closer to an art gallery owner allowing people to hang art and then changing their minds and taking all the art down and not giving the artist a chance to come get it.

Yeah, they painted it with consent of the owner. The message this sends out to the property owners of the city/state is, If you allow someone to create "art" on your property you may lose some of your rights to that property. The unforeseen consequence will be that it will become more difficult to convince property owners to allow such paintings in the future.

Whats going to happen to 'Graffiti Park' in Austin when it gets turned into MultiFamily property? Never been but it appears thousands of people have 'painted' there.

That is a insane ruling. Some of these artists have tremendous talent and some of them make millions doing it.
I personally know one guy who has done that. When he was growing up he was considered a bad kid and criminal for his graffiti. He had a thing for putting art on things that moved. Trains, buses ect. Became what is known as one of the Kings of Graffiti and has a world wide following, and I mean world wide. Opened a shop and started tattooing with his art skills. Now has art 2 galleries. One in France and one in Germany working on one in Las Vegas. He is currently making and designing toys and selling his art on prints.
Those pics Black Ice posted are on the lower east side of NYC and had the full cooperation of the buildings owner. Those are in the artsy SoHo area.
Some of the detail these artists can translate with a spray can is amazing.
Today in NYC some building owners would love to have artists to come paint their walls, garage or trucks.

If you've never seen it in person you have no idea.

I hate vandalism but this wasn't.
Some of those guys got paid to put those murals up

They are artist

For someone to make a 40 foot tall 3D portrait on the side of a building with a few cans of krylon takes an insaneamount of skill

I'm just playing Devil's advocate here, but that building has been photographed more times than we know. More video clips than we know about. These artists have no problem finding pictures or videos of it.

To be clear, I'm not calling this Vandalism and I actually like the idea of it. If I was a building owner I could pay someone to keep up the paint of the exterior of my building or I could let some "rattle can artist" paint it for free (if it isn't in bad taste). I prefer the art to the ugly side of a building. But.....His building, his right to do as he pleases. When these guys agreed to paint the building they knew they didn't own the "canvas" and therefore never controlled the situation. Giving these guys millions of dollars because the building owner decided he wanted to paint HIS building just seems wrong to me. I would argue these guys already benefited for all the tourism and name recognition they got over the years by this building owner allowing them to showcase their work to the world. He shouldn't owe them a dime. They owe him a "Thanks" for the exposure.

I agree. While the building owner probably did not pay for the, "art" I see it the same as buying a painting and deciding to torch it.

Yeah yeah yeah. It is neat looking and took WAY more skill than I will EVER have but.......It was still HIS FRICKIN PROPERTY!!! The graffiti vandals that painted there can come paint whatever the hades they want on YOUR WALLS?!?!? Right ?!?! Because that is exactly what almost everyone is saying.

The USA is becoming more Socialist with ever day.
