    Lawyer question - Mental PoA

    I never heard of a mental power of attorney. When did this come into play?

    And when someone has medical POA it clearly states they make decisions if/when the person can not make those decisions. So if said person goes into a psychotic break the medical POA is not good? Doesn't make sense to me when the person is clearly out of their mind.

    Anyone deal with this sort of thing?


    And how could it even be possible to get any POA from someone on a psychotic break?

      My mother and uncle shared power of attorney over a family member. One was over money and the other over the person.
