At the least it helps bolster the TBHers court case in that the people that paid out cash on this claim...don't think he did anything wrong.

Have you checked with your homeowners insurance to see if they might cover you? If you have liability coverage it might kick in.

So the guy is claiming to be certified legal document preparer. I would find out who regulates CLDP in Arizona and call them to verify if this gentleman is actually licensed. Also, I would ask if CLDP are authorized to file lawsuits on behalf of another and if CLDP are authorized to hold themselves out to be lawyers.

He has a Facebook page titled "Law Office of Silviano Tanori."

If either one of those responses is "no" I would file a complaint. Then I would report the un-authorized practice of law to the Arizona State Bar. Its called barratry and in Texas its both a crime and aggressively prosecuted.

If he does possess the authority to file lawsuits on others behalf, you need to hire an attorney in Arizona. Someone local, respected and with knowledge of "how it works." That normally doesn't mean cheap. This situation sucks.

The plaintiff signed the petition, not Silviano. Anyone can file a petition in justice court, it looks like Silviano maybe helped prepare it but isn't representing the plaintiff. This is the most ridiculous thing I've seen. The stupid thing is that it was filed in justice court, and (at least in Texas) the justices aren't licensed to practice law and anything can happen. I tell clients if they get sued in justice court to save their money and try the case themselves - if they win, great, if they lose, just appeal to a higher court and it starts all over with a judge that is a lawyer and understands the law. I am not licensed in Arizona, but my suggestion would be to look into the appellate procedure in this matter. It is my opinion (not legal advice) that a Motion to Dismiss would take care of this in a higher court, the petition just doesn't make sense, I don't know that this plaintiff has standing to bring an "insurance fraud" cause of action.

At any point did your insurance company settle with you on the vehicle? Was there any affidavit signed by you upon settlement with the insurance company?
This would appear to be a situation that could be cleared up with minimal effort. Craziest thing I have ever heard of.

Yes they settled with me. not sure on the affidavit

You live in/were served in Texas.
Plaintiff lives in Arizona.
Plaintiff sues you for just under jurisdictional limits in play court.
Cheese-ball guy in Jeep sports white shorts, likely before Easter, and says pay up, sucka!

File MTD, plea to jx, and cite Pennoyer v. Neff, International Shoe and any case you can find with a Japanese tire company as a party. That will do. :-)

Bottom line. . . if we had that dang wall built in 2014 none of this would have happened.

I wrote another nice letter (motion to dismiss) and called to make sure the judge could review it before out court date. They did and dismissed the case
I was told that most people in their case are chasing a settlement knowing I am from out of state.

Did I say something offensive to you? I don't see any need for personal attacks. No need to be an internet tough guy. I simply made an observation on the amount of lawyer threads that pop up on the recent threads list. There is actually another one now as well. I don't start the threads so how am I possible a bad person?
