The Supreme Court changed this in 2014 in Abramski v. US. In a 5-4 decision they held that purchasing a firearm on behalf someone else is a straw purchase even if both parties could legally purchase the firearm.

The OP would still be able to purchase a firearm and give it to his grand daughter as a gift. He is not purchasing the firearm on her behalf if it is truly a gift.

To further add to this a straw purchase is when you purchase a firearm for any other party having recieved any form of compensation from said party or planning to recieve any form of compensation from said party. It is perfectly to buy a fire arm for a gift if the reciever can legally own a firearm.

That case was decided as a straw purchase because he gave the money to the buyer to go and purchase the gun for him. If the buyer had purchased the gun with his own money, and sold it to him later it wouldn't have been a straw purchase. Seems pretty stupid doesn't it.

I believe if you read the instructions on the 4473 form, it tells you it is legal to gift a firearm to another after purchase. It is in the instruction concerning the line where it askes you if the firearm purchase is for yourself. Perfectly legal to gift a firearm to some one after you purchase it. As long as they are legal to own it. A dealer will know this, a counter salesman at academy may not.

              (1) Be careful asking for advice from the internet-keyboard-ninja-warrior legal team (present company included).

              (2) No one has yet asked you the most important question: Is your granddaughter a resident of Texas?
