I can't believe this is an actual question. I'm so sick of politics playing a part in the Supreme Court. I know that's just the way it is, but it's sickening.
If all the justices would interpret the constitution based on what it actually says, respecting the original intent and meaning, then politics wouldn't play a part. But the liberal justices who think it's their job to reinterpret the constitution and legislate from the bench when they don't like what the law says are the problem. We need more like Scalia who abide by the actual constitution if we want to get politics out of the Supreme Court's actions.
And Cruz is the candidate who would do the best job of appointing such a justice. Trump would be unlikely to do so.
This question is always an important reason for my vote. With the death of Justice Scalia it is the one, overriding factor for me this year. The Constitution lost her greatest supporter with his death
I want someone who will nominate a Justice who believes in Original Intent. To me that is Cruz. I am hopeful Senator Sessions will have some input if Trump is President but you know more of what you would get with Ted.

I for one believe it would be Cruz. I'm not so sure what we would get from Trump although I know he spoke highly of Scalia.
I just don't hear Trump speaking about the constitution as much as Cruz does and when he does he doesn't have the same passion as Cruz does.
Trump also pretty much called Scalia a racist after a SC decision a few months ago.

A much more likely scenario would be that an approval of any judge appointed by Obama would be very costly for congress.. The silent majority has awaken... and while they may still be groggy from sleep and can't clearly define the candidate they want...

Republicans (majority leader McConnell) are following the rule change in the Senate ( per Napalitano sp.) passed several years ago. Also, this delay is in accordance with advice given on the floor of the Senate and referred to as the "Biden Rule"

That is already in the works... I know with all the Trump, Bernie, and Hillary attention grabbing going on, most forget that this Nov election is about much more that POTUS.... there are LOTS of incumbent Congress pukes who are crapping themselves, and picking out new office furniture.
Justice Scalia's seat is vacant. Ginsberg is 82 years old, Kennedy is 79, Breyer is 77, and Thomas is 67. Nowadays, the data shows that the average age of a Supreme Court retirement or death occurs after 75.
These are 5 vacancies that will likely come up over the next 4-8 years. The next President will have the power to potentially create a 7-2 Supreme Court skewed in their ideology.
Think about that... 7-2. If the next President appoints 5 young justices, it will guarantee control of the Supreme Court for an entire generation. And 7-2 decisions will hold up much more over time than 5-4 decisions which are seemed to be lacking in mandate.
Hillary has made it clear she will use the Supreme Court to go after the 2nd Amendment. She has literally said that the Supreme Court was wrong in its Heller decision stating that the Court should overturn and remove the individual right to keep and bear arms. Period.
Everyone saying that they won't vote for one candidate or the other if they are the GOP nominee, please realize this. If Hillary Clinton wins and gets to make these appointments, you likely will never see another Conservative victory at the Supreme Court level for the rest of your life. Ever.
If you are a Conservative, a vote for anyone but the GOP nominee, whomever that will be, is a vote for Hillary Clinton.
With Trump we are rolling the dice but we may not have a choice.
Kasich and Rubio is about 60/40 for a conservative pick.
With Cruz there is no doubt. He is our only sure shot, like him or not.
