    Law Enforcement/Legal Question

I found out last night that a neighbor of mine was arrested for (11990004 Aggravated Sexual Assault Child F1 94 FEL-1).

    What exactly is the charge?

And this is what it says on the case history

Event ID Orders of the court Date Note
943 Crimes against children (CAC) 04/21/2008
111 Case Filed by Indictment 06/10/2008
113 Notice to Appear Issued 06/11/2008
    948 Bond Set $ 75,000.00 06/16/2008
348 Letter of Representation D. Scoggins retained 06/24/2008
    230 First Appearance 6/24/08 9:00 06/24/2008
    131 Passed 06/24/2008
309 Victim Impact Statement Filed 07/02/2008
    231 Announcement 7/24/08 9:00 07/25/2008
    131 Passed 07/25/2008
    231 Announcement 08/22/2008

What does the (Passed) and (Announcement) mean? I assume that the 08/22/2008 Announcement is his next day in court.

    Thanks

"Passed" - typically means the case was not resolved on that date. Therefore, the Defendant would be required to come back to court on the reset date.

"Announcement" - usually refers to whether each party (State & Defendant) is ready for trial.

If Collin County is anything like Harris County, it usually is a number of months or can be years before the case is resolved.

what does the "Aggravated" part of the charge mean? Use of a weapon? Age of the child?

agrravated is the use of a weapon.

sounds like you have yourself a nice little child molestor next door. Send in the cleaning squad and get rid of him.

A weapon is just one possible scenario. The more likely scenario is the victim was under 14. Click the link and read section 22.021

I know in adult cases "Aggravated" meant the use of a weapon, but I was thinking that "Aggravated" also referred to the age of the child, like under a certain age or something like that.

Chew, that pretty much explains it.

                  Thanks

Aggravated means different things in different offenses (Perjery, Robbery, Assault, Kidnapping, Sexual Assault, etc.).

Use of a weapon, causing serious bodily injury, and age of the victim are some of the various factors. But each offense is different.

I guess innocent until proven guilty doesn't apply?

I'd draw the line in the sand with the guy, and tell him what happens should he be dumb enough to cross it. Everybody deserves their day in court.

Do you know who the child was?
